Terms and conditions

Terms and conditions for the sale of tickets for tohoop Festival 2027 (19 to 22 August 2027, Kulturhof Ovendorf, Negenharrie). This is a translation for convenience; the German version is binding.

1. Scope and organiser

These terms apply to all orders in the ticket shop at tickets.tohoop-festival.de. The organiser and contracting party is Gemeinschaftsgefühl UG (haftungsbeschränkt), Jungfernstieg 21, 24103 Kiel, Germany, info@tohoop-festival.de (“we”). The other contracting party is the person who places the order (“buyer”). People a ticket is issued to are called “ticket holders”.

2. Conclusion of the contract

Showing tickets in the shop is not yet a binding offer. By completing the order, the buyer makes a binding offer. The contract is concluded when we confirm the order by email. Only adults can buy tickets.

3. Prices and payment

The prices shown in the shop at the time of ordering apply. Payment is made by bank transfer within 14 days of ordering. If payment has not arrived by then, the order expires automatically and the tickets are released again. Tickets are sent by email once payment has arrived.

4. Cancellation before payment

As long as an order has not been paid, the buyer can cancel it free of charge and without giving reasons within the 14-day payment period, using the link in the order confirmation or by emailing us. Once paid, an order can no longer be cancelled by the buyer; the ticket can, however, be transferred to another person as described in section 6.

5. No right of withdrawal

Under section 312g(2) no. 9 of the German Civil Code (BGB), there is no right of withdrawal, as the contract concerns a leisure service to be provided on a specific date. The voluntary cancellation option before payment under section 4 remains unaffected.

6. Personalised tickets and transfer

Tickets are issued in the ticket holder’s name and are only valid together with official photo ID. A ticket can be re-personalised to another person free of charge at any time. Re-personalisation is only possible through tohoop Festival: via the re-personalisation in the ticket shop or on request by emailing info@tohoop-festival.de, and we will reissue the ticket in the new person’s name. There is no other way to pass on a ticket.

Offering or selling tickets on third-party platforms is not allowed, in particular on eBay Kleinanzeigen (kleinanzeigen.de) and TicketSwap (ticketswap.com) as well as on comparable classifieds sites, ticket exchanges and secondary-market platforms. Reselling a ticket for more than its original price and any commercial resale are not allowed either. A ticket is only valid for the person it is issued to; without re-personalisation by us, it does not entitle anyone else to admission. If a ticket is demonstrably resold for more than its original price or commercially, we may block it; there is no entitlement to a refund in that case.

A lost ticket can be sent again to the email address given in the order at any time (resend ticket) .

7. Admission and age

Admission from 18 years. Age is checked at the entrance using official photo ID. There is no right to admission without a valid ticket and matching ID.

8. Awareness and rules on site

Our awareness concept applies on site. We do not tolerate discriminatory, abusive or dangerous behaviour. Anyone who violates it can be excluded from the festival without a refund. Pets, drones, campfires and open fire are not allowed on site.

9. Cancellation, postponement and programme changes

If we cancel the festival, we refund the ticket price in full. If we postpone it, tickets remain valid; anyone who cannot attend on the new date gets a refund on request. Changes to the programme, such as individual acts or times, do not entitle anyone to a refund. If we have to cancel the festival for reasons beyond our control (such as severe weather or orders from the authorities), we also refund the ticket price in full. If we have to stop it after it has started for such reasons, we refund the ticket price proportionally for the festival days that did not take place. There are no further claims in these cases, for example for travel or accommodation costs.

10. Photos and recordings

The festival has a no-photo policy: photos and videos in which other people could be recognised are not allowed, especially on the floors. If we arrange recordings ourselves, we announce this beforehand and make sure nobody is shown recognisably against their will.

11. Liability

We are liable without limitation for intent and gross negligence and for injury to life, body or health. For slight negligence, we are only liable for breaches of essential contractual obligations, limited to the foreseeable, typical damage. Essential contractual obligations are those whose fulfilment is necessary for the proper performance of the contract in the first place and on whose observance the other party may regularly rely. We accept no liability for belongings brought along unless we are at fault. The festival is loud; we recommend ear protection.

12. Final provisions

German law applies. We are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board. If any provision of these terms is invalid, the remaining provisions stay in effect.
